Provincial Legal Office hosts flag raising ceremony

The Laguna Provincial Legal Office (PLO) headed by Atty. Rodel T. Paderayon hosted the weekly flag raising ceremony on January 8, 2018 at the provincial capitol Time Plaza. In behalf of Atty. Paderayon,Atty. Laurence L. Pasia, PLO Legal Officer II, reported on the accomplishments of the office for the year 2017.
 
 

Introduction

 
            Looking back at the traces of significant events, year 2017 was marked with myriad accomplishments by the Provincial Legal Office. Serving as the principal law agency of the Province, the Provincial Legal Office has responded well to the challenges of time by implementing programs, plans, and services directed towards strengthening and protecting the interests of the Province of Laguna pursuant to the present administration’s key program “Rise High Laguna, Serbisyong Tama.”
 
 

Mandate

           
            The Provincial Legal Office derives its functions from the provisions of Republic Act No. 7160 otherwise known as the Local Government Code of 1991. It is mandated to uphold the rule of law and ensure the effective and efficient administration of justice.
 
 

Programs and Services

 
            The programs and services of the Provincial Legal Office include court representation and prosecution, rendition of legal opinions, and preparations and reviews of contracts. They also include the rendition of legislative liaison services such as attendance in SangguniangPanlalawigan hearings, giving of legal opinions or advice and drafting of ordinances and resolutions submitted to the Sanggunian. The Provincial Legal Office also performs other functions relating to other agencies in the province such as the Provincial Administrative Disciplinary Body (PADB), the Laguna University (LU), the Personnel Selection Board (PSB), the Bids and Awards Committee (BAC) and the Laguna Provincial Public Auction Committee (LPPAC).
 
 

Technical Working Group

           
            In carrying out its functions, the Technical Working Group (TWG) of the Provincial Legal Office serves as the primary support group to the Provincial Attorney. It has managed well with the review of contracts, memorandums of agreement (MOAs) and other agreements entered into and signed for or in behalf of the Province. It is responsible in the drafting of comments, opinions, and letters to different municipalities, component cities, and inter-agency units of the Provincial Government of Laguna
.
            In the year 2017 the Provincial Legal Office has reviewed numerous memorandums of agreement/understanding and other forms of contracts/agreements that have important impact on the policy programs of the present administration towards its vision of rendering public service with accountability, effectiveness and efficiency. Among others, the Office reviewed the memorandum of agreement with different universities and colleges relative to work immersion partnership, the memorandum of agreement with the Department of Interior and Local Government - Regional Office No. IV-A represented by its OIC-Regional Director, Manuel Q. Gotis for the implementation of the performance challenge fund (PCF) in the amount of Four Million Pesos for projects and/or programs of the Province of Laguna, the memorandum of agreement with the Department of Health (DOH) Regional Office IV-A relative to the implementation of medical assistance program to indigent and poor patients of the Department of Health and for other purposes, and the memorandum of agreement with Philippine Health Insurance Corporation (PhilHealth) for the implementation of the sponsored program component of the National Health Insurance Program (NHIP) for the marginalized and underprivileged residents of the Province of Laguna and for other purposes.
 
 

Heavy Workload

 
            At present, the Provincial Legal Office is being manned by three (3) lawyers and fourteen (14) support personnel. Considering this number, the office has effectively accomplished the following services from the month of January 2017 up to December 2017:
The Provincial Legal Office has represented and still represents a total of twelve (12) active court cases. Nine (9) of which are Civil Cases and three (3) are Land Registration Cases. It has reviewed a total of seventy-one (71) contracts, forty-three of which are memorandums of agreement, twenty-two (22) contracts of lease, two (2) contracts of services, and four(4) deeds of donation. In addition, the office has rendered a total of twenty (20) legal opinions in standardized formats.
 
            With respect to its subsidiary functions, the office has rendered a total of one hundred and forty-four executive-legislative liaison services which include executive issuances in the forms of executive orders, office orders, administrative orders, and office memoranda, and SangguniangPanlalawigan referrals which include endorsements, draft resolutions and ordinances.
 
            The Bids and Awards Committee, chaired by the Provincial Attorney has successfully procured a total number of three hundred six (306) infrastructure projects, and one hundred forty-one (141) goods in the year 2017. It has also posted a total number of four hundred and forty-eight (148) alternative modes of procurement on PhilGeps in the said year.
 
The Office has also performed ten (10) subsidiary services in Laguna University which include four (4) minutes of meeting and six (6) BOR resolutions.
 
The Provincial Administrative Disciplinary Body (PADB), which is also chaired by the Provincial Attorney, handled nineteen (19) cases in the year 2017, seven (7) of which have successfully been resolved, eleven of which are pending deliberation or resolution and one is currently active.  
 
Lastly, the Provincial Legal Office has extended a total number of seventy (70) legal assistance in the forms of endorsements to the Public Attorney’s Office and other government agencies and assisting walk-in clients.
 
 

Plans and Programs for the Year 2018

 
            In 2017, the Provincial Legal Office commenced and consolidated key reforms into an organized set of strategy-based plans and programs to improve the delivery of legal services to all constituents in the Province of Laguna, focusing on the professionalization of procedures, structures, and system of operations, considering its limited resources. The following are the major plans and programs of the Office for the year 2018:
 
            The Provincial Legal Office aims to standardize the procedures and guidelines concerning review of contracts and other agreements, and perform tasks in accordance with the ISO system procedure and document monitoring implementation. It also aims to rationalize monitoring and recording system of all endorsements, memoranda, contracts,and other documents executed and released by the Office. It also plans for a review of organization and staffing structures by formulating and implementing standardized procedures and guidelines embodied under the Provincial Legal Services Manual for Operations.
 
            The office also plans to implement Service Capacity Enhancement Program which includes conducting and attending seminars in coordination with other national agencies relative to recent law developments pertaining to LGUs and/or local governance and the constitution of a coordinative body consisting of all municipal legal officers to draw common programs and/or plans for the betterment of local governance.
 
The development of the LAG-Legal E-Library is also one of the aims of the office for the year 2018 in order to make accessible online legal researches and/or reference materials including legislations and executive issuances in the Province of Laguna.
 
Given the growing number of tasks that the Provincial Legal Office needs to perform, it constantly finds means to improve its services and be more efficient the discharge of its functions. The Provincial Legal Office shall always stand for what it is mandated to do, that is to uphold the rule of law and ensure the effective and efficient administration of justice in the Province of Laguna.
